Today we are talking to Harvard Law Professor Mark Tushnet about his book Who Am I to Judge: Judicial Craft versus Constitution Theory . It’s common today for Supreme Court justices to outline a theory of constitutional interpretation, but it turns out that not only is this dishonest, but also something that only developed in the late 20th century. Enjoy! The Ian Toll book series Ryan mentions can be found here .…

Happy Friday! Sam and Emma speak with Heather Digby Parton , contributing writer at Salon.com and proprietor of the blog Hullabaloo , to round up the week in news. First, Sam and Emma run through updates on Trump’s cuts to the Social Security Administration, Musk’s attacks on NOAA, the devastating effect of Trump’s gutting of USAID, FEMA’s struggles, Bird Flu, the Pentagon’s trans ban, Trump’s tariffs, and MAGA confusion about Trump releasing an edited Epstein file, before expanding on the GOP’s ongoing attacks on Medicaid and Social Security, highlighted by the obvious attempt to revamp the demonization of people who receive government benefits. Digby then joins, jumping right into the genuinely astonishing divide between federal and state-level Democrats’ ability to function as an opposition party, with Democrats in New York, California, and the Midwest embarrassing national leadership when it comes to preparing (or caring) to fight the Trump administration. Parton, Sam, and Emma also reflect on the coalescing of Big Tech and the Heritage Foundation, dissect some of Elon Musk’s deeper desires for collecting Americans’ data, and assess the chokehold the Musk-Trump regime has on the rest of the Republican Party – from the threat of a primary to the active disregard of their voters’ wishes. After touching once more on the impotence of national Democratic leadership (Hakeem Jeffries) in contrast with state-level leaders (Governor Walz), Digby and MR wrap up by diving deep into Trump’s insane authoritarian confrontation with Ukraine President Zelenskyy during a live press conference today. And in the Fun Half: Sam and Emma watch Kaitlan Collins stump Mike Johnson with confusing questions about “budgets” and “resolutions,” and cringe as Piers Morgan goes out of his way to rain shimmering showers of praise on Elon Musk (while just happening to defend his own wealth along the way), plus, your IMs! Forget the Epstein files hullabaloo. Members of the Trump administration, perhaps at the urging of Barron Trump, seem to have directly intervened to get the travel ban lifted on the Tate brothers, who are charged with rape and sex trafficking in Europe. Meanwhile, a "Keep Christ in Christmas" extravaganza is being planned at the Kennedy Center, where Trump is now chair. Plus, the con behind crypto is going to run out of fools, CEOs are regretting their bet on Trump, Kash wants to run the FBI part-time from Vegas—and the Dems need to try on a little shamelessness and make Trump own the spiraling price of eggs. 1 The Great Simplification with Nate Hagens: (Some of) The Central Questions of Our Time | Frankly 87 17:20
The period of relative peace and stability we’ve known - enabled by the energy surplus of the Carbon Pulse and the ecological stability of the Holocene - is slipping away. AI is turbocharging the Superorganism, governance structures are fraying, and ecological shocks are intensifying. As the Great Simplification approaches faster than expected, are we asking the right questions? In this Frankly, Nate invites us to reflect on some of the most urgent questions of our time - and what they might mean for both our collective and individual trajectories ahead. Can open societies endure on the downslope of the Carbon Pulse? Is a future without large-scale war still possible? As the pace of change accelerates, the challenge isn’t just understanding what’s coming, but deciding how to respond. What would you not regret doing if you knew major disruptions were imminent? Can you redirect frustration into meaningful action? And in a world that increasingly pulls us apart, can you help build a ‘coalition of sanity’? Something alarming is happening with reading in America. Leisure reading by some accounts has declined by about 50 percent this century. Literacy scores are declining for fourth and eighth graders at alarming rates. And even college students today are complaining to teachers that they can’t read entire books. The book itself, that ancient piece of technology for storing ideas passed down across decades, is fading in curricula across the country, replaced by film and TV and YouTube. Why, with everything happening in the world, would I want to talk about reading? The business podcaster Joe Weisenthal has recently turned me on to the ideas of Walter Ong and his book 'Orality and Literacy.' According to Ong, literacy is not just a skill. It is a specific means of structuring society's way of thinking. In oral cultures, Ong says, knowledge is preserved through repetition, mnemonics, and stories. Writing and reading, by contrast, fix words in place. One person can write, and another person, decades later, can read precisely what was written. This word fixing also allows literate culture to develop more abstract and analytical thinking. Writers and readers are, after all, outsourcing a piece of their memory to a page. Today, we seem to be completely reengineering the logic engine of society. The decline of reading in America is not the whole of this phenomenon. But I think that it’s an important part of it. Today we have two conversations—one with a journalist and one with an academic. First, Atlantic staff writer Rose Horowitch shares her reporting on the decline of reading at elite college campuses. And second, Nat Malkus of the American Enterprise Institute tells us about the alarming decline in literacy across our entire student population and even among adults. If you have questions, observations, or ideas for future episodes, email us at PlainEnglish@Spotify.com. U.S. President Donald Trump has announced a new aspect of his administration’s immigration policy: a path to citizenship for “high-level” people who can bypass the usual process by paying $5 million. Trump said the program will raise revenue for the government—but it might primarily attract Russian and Chinese oligarchs to the United States. Joining us this week is Alex Thorn to break down why crypto markets are taking a hit. Major hacks, bearish macro signals, and fresh tariffs from the U.S. all played a role. But it’s not all bad news: the SEC is backing off from lawsuits against Coinbase, OpenSea, and Uniswap, signaling a potential shift in regulatory pressure. Plus, Bybit suffered the biggest crypto hack ever, losing $1.5B—how did it happen, and who’s behind it? A week from today we will get the February jobs report and there are growing concerns that the US labor market is slowing. Already, the number of sectors adding jobs in this economy is on the decline. Meanwhile, the housing market continues to struggle. Add in the Department of Government Efficiency and worsening fiscal conditions in the state and local sector, and the government may prove to be a drag on employment. To talk about this and other macro developments, including possible tariffs, we brought back Jon Turek, founder and CEO of JST Advisors, to break it all down on this episode. Donald Trump’s return to office has inspired constant breaking news headlines. This week: The administration faces scrutiny after the Elon Musk-led DOGE team instructed all federal workers to justify their employment via email. Should government workers take the threats seriously? Differentiating what’s worth worrying about might be difficult when words like “oligarchy” and “autocracy” get thrown around. Trump may be a polarizing figure, but is he definitionally an oligarch? KCRW examines how messaging affects the national conversation about the presidency. Later, the Left, Right, and Center panel takes a listener question about the merits of American bicameral politics over parliamentary systems. Does our current government enable this kind of disconnect between executives and the electorate? Could a parliamentary shift fix our problems?…

Noah compares Ukraine war to Finland's Winter War - Ukraine may lose territory but maintain independence. Richard supports technological progress, believing future generations should benefit from AI and genetic engineering. Noah argues societies that resist technological progress inevitably get left behind in global competition. Richard expresses skepticism about Democrats' ability to reform, citing Obama's failed education reform efforts. Edward Fishman, author of Chokepoints: American Power in the Age of Economic Warfare , is back to discuss the immense power of tariffs, and economic leverage—and how Trump’s understanding (or lack thereof) of these tools. Plus, Trump grumbles to British PM Keir Starmer that Ukraine isn’t paying back U.S. aid, and in The Spiel, what Democrats can actually stand for beyond simply resisting Trump. It's an EmMajority Report Thursday! She speaks with Trita Parsi , Executive Vice President at the Quincy Institute For Responsible Statecraft, to discuss the U.S.'s recent turn against its allies and towards Russia and other world powers. Then, she speaks with Hanno Hauenstein , independent journalist based in Berlin, to recap the German election results from this past Sunday and what to look for going forward. First, Emma runs through updates on the decimation of USAID, Trump’s attacks on the EPA, DOGE’s fraud/waste/abuse, the looting of HUD, the FAA’s new pitch for Elon’s Starlink, the IRS, the GOP’s Medicaid cuts, RFK’s first US-based measles death, a new illness out of the Congo, and Israel’s escalations in the West Bank, before watching Trump make the whole cabinet bend the knee to Elon Musk in front of the press. Trita Parsi then joins, as he and Emma dive right into Trump’s immediate pivot on US-Russia and Ukraine relations, including siding with Russia and Israel on the UN stage and blanket rejecting criticism of Russia or a diplomatic track for the invasion of Ukraine, and the obvious and direct parallels with Biden’s unapologetic support for Israel, with Trump acting much more as an accelerant – rather than an opposite – to Democratic Party foreign policy. After touching on Sleepy Joe’s expansions on the Trump-era Abraham Accords, Parsi parses through Biden’s general effort on the global stage to undermine international law and American soft power in the lead up to a second Trump Administration, before wrapping up the interview with the impending response to Trump’s Gaza ethnic cleansing plan from Arab leaders in the region, and the importance of meeting Trump’s extreme plan with a bolder response: a Palestinian State. Hanno Hauenstein then joins, first briefly running through the rise and fall of Germany’s “Traffic Light coalition” between Social Democrats, Greens, and Neoliberals in the vacuum of Merkel’s coalition, until the growing threat of the far-right over the past few years saw the centrist coalition – like many other centrist governments in the West – attempt to co opt the extremist AfD’s talking points under softer, liberal language, unfortunately gutting their own popularity instead of AfD’s, with the party winning 20% of the vote. After expanding on AfD’s recent evolution, and the rest of the German right’s theoretical refusal to go into coalition with AfD, Hanno and Emma briefly touch on the genuine boost felt by the Left party in the recent election, dive much deeper into the collapse of the Social Democrats and Greens, and the major anti-Palestinian crackdown that has faced the German left over the last year and a half, before wrapping up by emphasizing the threat posed by a growing far-right in Germany. And in the Fun Half: Emma is joined by Brandon Sutton and Matt Binder as they unpack New York’s ongoing Democratic Primary for Mayor, from Zohran Mamdani separating himself from the progressive pack to the ever-developing Eric Adams crashout. They also listen to Ben Shapiro brazenly lie to his listeners about Medicaid, and discuss Trump’s release of the Tate brothers to the shagrin of… Ron DeSantis? Plus, your calls and IMs! The Trump administration continues to ice out the Associated Press, and now the AP is suing. We discuss how the administration changed its argument (not great, from a policy perspective, but it may actually put the White House on stronger legal ground). Ed Martin — the conservative activist serving as acting US Attorney for the District of Columbia, whom Trump has named to be the permanent US Attorney for that district — continues to send out weird, threatening letters about non-criminal behavior by Democrats. Ken has instructions about what you should do if you get such a letter. Plus: Eric Adams now wants the charges against him dismissed with prejudice ; Sam Bankman-Fried has a theory of why he, too, deserves special dispensation from the Trump administration ; FIRE mounts a robust defense of pollster Ann Selzer ; the Trump administration continues to face difficulty in the courts with its executive orders; and soon-to-be-long-suffering federal Judge Ana Reyes ( last seen scolding the attorneys for inspectors general suing the administration ) has drawn the ire of the administration itself for being too mean to them in court . In the latest episode of Liberty and Learning, Mark Levin and Dr. Larry Arnn engage in a captivating discussion about the role of federal district judges and their impact on the executive branch. As the conversation unfolds, they explore the historical context of judicial power, the implications of overreach by judges, and the urgent need for Congress to take action to restore balance within the government. Levin and Arnn begin by discussing how federal judges are created by Congress and the limitations of their authority. They highlight the importance of the separation of powers, a fundamental principle that ensures no single branch of government can dominate the others. This principle is crucial for maintaining the rule of law and protecting the rights of citizens. One of the key points raised is the alarming trend of federal judges making nationwide rulings that disrupt the functioning of the executive branch. Levin and Arnn argue that this overreach not only violates the common sense understanding of judicial authority but also undermines the very foundation of our constitutional system. They emphasize that judges should only decide cases that directly involve the parties before them, rather than issuing sweeping injunctions that affect the entire nation. As the conversation progresses, the duo delves into the role of Congress in addressing judicial overreach. They stress that Congress has the power to legislate and could easily pass laws to limit the authority of district judges. This is a crucial point, as it highlights the responsibility of elected officials to uphold the Constitution and ensure that the government operates within its designated boundaries. The discussion also touches on the historical significance of the Dred Scott decision, which serves as a reminder of the potential consequences of judicial overreach. Levin and Arne draw parallels between past and present, suggesting that we are at a critical juncture in history where the balance of power is being tested once again. Liberty and Learning with Mark Levin and Larry Arnn is a 10-part series, hosted by veteran broadcaster and constitutional law expert, Mark Levin, and his good friend, Dr. Larry Arnn, President of Hillsdale College, dives deep into the founding principles of the U.S., as Americans face both crisis and opportunity. Levin and Arnn take listeners on a journey forward, as they unpack the country’s basic foundations and the self-government they require. Mark Levin and Dr. Arnn bring their knowledge and wisdom to bear in a candid conversation between lifelong friends on today’s latest news events. They will touch on the points of crisis in America, addressing each in light of our constitutional government, and tackling the pressing issues of our time to see how they fit into the grand tapestry of American history. The discussion will delve deep into the issues at the forefront of our nation’s concerns, like education, borders, citizenship, separation of powers, state and local government, and much more. But today, we’re diving into the bromance between Elon Musk and Donald Trump, and more specifically, how it’s impacting the changing right-wing political movement here in the United States. There’s no better place to get that temperature check than CPAC. Musk showed up there this year for a wild interview — you may have seen clips of him waving around a literal chainsaw. Thankfully, Verge policy Gaby del Valle was on the ground this year, and as you’ll hear her say, she barely slept. The first month of the Trump administration has been noisy and novel by basically any measure. But perhaps the biggest shockwaves have been in the realm of geopolitics. Europeans were caught off guard by a recent speech given by Vice President JD Vance in Munich, calling into doubt the future of the Trans-Atlantic partnership. Meanwhile, when it comes to tariffs, the Trump administration has actually been tougher on Mexico and Canada than it has been on China. Then add into all of this the anxiety over AI domination, as a result of the hype around DeepSeek. So how should we understand these novel risks? And how should investors incorporate them into their thinking? On this episode we speak with Jared Cohen and George Lee, the co-heads of the Goldman Sachs Global Institute. They discuss the future of Europe, what they're expecting from the Trump administration, the rise of the Gulf powers, AI, undersea cables, and the opportunities in identifying what they call "geopolitical swing states" like Japan and India. Today Razib talks to Antonio Regalado , reporter at MIT Technology Review . Regalado covers how technology is changing medicine and biomedical research. Before joining MIT Technology Review in 2011, he lived in São Paulo, Brazil, where he wrote about science, technology, and politics in Latin America for Science and other publications. From 2000 to 2009, he was a science reporter and foreign correspondent at the Wall Street Journal . Among the many stories Regalado has broken was the prenatal sequencing of Razib’s son in 2014, but on this episode they talk about another scoop: his 2018 reporting on the “CRISPR babies” (listen to a podcast on the topic with Regalado on The Insight ). Starting in 2024, the scientist who led the 2018 gene-editing of two babies in China, He Jiankui, seemed to embrace a new role as self-appointed social media evangelist and oracle, mostly about his own future. Regalado talks about what he thinks the Chinese scientist is up to, where the field of CRISPR-gene editing is at present and where it is going. Razib and Regalado also discuss the rise and fall, and future prospects, of CRISPR biotech startups attempting to develop therapies that deploy gene-editing. Regalado also muses on the emergence of companies that provide genomic technologies and services like embryo screening in the “gray market” away from public view.…

On this episode of Unsupervised Learning Razib talks to Daniel McCarthy, editor-in-chief of Modern Age . Former editor-in-chief of The American Conservative , his writing has also appeared in the New York Times , USA Today , The Spectator , The National Interest and Reason . McCarthy also helped run communications for the 2008 Ron Paul campaign and was a senior editor at ISI Books. He earned a Ph.D. in classics from Washington University in St. Louis. First, Razib and McCarthy discuss the outcome of the 2024 presidential election, and the realignment of coalitions on both right and left, and what these realignments might presage for both parties’ future. McCarthy also outlines the long march of anti-war conservatives who organized themselves around The American Conservative in the first George W. Bush term, their eventual move into the mainstream and poll position in the discourse under Donald Trump. Razib asks about the origins of modern conservatism’s divisions, going back to William F. Buckley’s founding of National Review in the 1950’s. McCarthy also talks about Russell Kirk’s role in the development of post-World War II conservatism, which included the founding of Modern Age , a more intellectual and philosophical publication than National Review . It's Hump Day! Sam speaks with Chris Geidner of the Law Dork newsletter on SubStack, to provide some updates on a number of court challenges to the Trump Administration's directives & executive orders. First, Sam runs through updates on the GOP’s budget resolution, US-Ukraine relations, Elon’s role in the Trump Administration, DOGE, an impending government shutdown, the GOP’s town hall-phobia, Trump’s “Gold Card” immigration plan, the EPA, longshoremen’s contract win, Oregon nurses’ contract win, and Bernie’s move on arms sales to Israel, before watching AOC eviscerate the GOP’s plan to cut taxes for the wealthy and benefits for the poor. Chris Geidner then outlines the various types of executive orders that have been coming from the Trump Administration, including legitimate executive actions, general memoranda, and insane musings, with an unfortunate majority landing in that latter category and often positing illegal, inhumane, and outrageous policy changes without more specific action entailed, ultimately making for a much more difficult challenge in court before the actual dangers are demonstrated. Expanding on the actual efforts to block these maneuvers, Geidner walks Sam through the expansive field of plaintiffs challenging everything from Trump’s funding freeze and firings to constitutionality and DOGE, examining the various organizations backing these efforts, and unpacking the legal strategy – particularly around the fourth circuit – that has brought them success so far. After touching on the constructive, methodical nature of the still-developing legal cases against the Trump Administration, Chris and Sam wrap up with the insanity of Trump’s impoundment maneuver and overwhelming attack on equal opportunity employment. And in the Fun Half: Sam unpacks Jeff Bezos’ announcement that the Washington Post will no longer publish opposing viewpoints to his own, watches Stephen A. Smith and Hakeem Jeffries take this moment to punch left, and admires White House Press Secretary Karoline Leavitt’s ability to crumble under pressure when Elon Musk’s role in the government comes into question. The MR Team tackles Trump’s insane AI-generated “Trump Gaza” video and absurd plan to put US citizenship up for purchase, before touching on his understandable fear of the Epstein Files. Mimi from Colorado discusses relationships with conservative family, Laura from Minneapolis highlights the importance of uplifting joy, and Max from New York examines Trump’s recent discussion of US v.
