Richard Allen's legal team has filed a new appeal in response to a court ruling that barred them from presenting alternative murder theories at his upcoming trial. This appeal follows a decision by Special Judge Fran Gull, who excluded the defense’s theory that Abby Williams and Libby German were killed as part of a ritual sacrifice tied to Odinism, a pagan religion. The defense argues that excluding this theory violates Allen's constitutional rights to present a complete defense and have a fair trial.
The appeal also challenges the admissibility of Allen's jailhouse confessions, which the defense claims were made under duress due to harsh conditions in solitary confinement. Additionally, Allen's team argues that the court's refusal to consider alternative suspects undermines their ability to establish reasonable doubt.
This appeal could delay the trial, which is currently scheduled for October 2024. The Indiana Court of Appeals' response to this appeal could significantly impact the progression of the case.
